    The Effect of Fraud on Land Dealings: A Case Study of Wakiso District in Uganda

    This research evaluated critically the effect of fraud on land dealings under section 77 of the registration of titles act cap 230. Therefore, this study aimed at discussing the impact of Land Information System and the different kinds of fraudulent dealings in Land matters, the legal effect of fraud in land dealings and the challenges and controversies between the law and the adopted mechanisms to fight fraud. The study adopted the doctrinal research method. This was done via an analysis of various laws and policies on land rights, dealings and possession in Uganda, international instruments on fraud, registration and transfer of title and writings of highly qualified publicists on the subject matter of this study. Parties have maneuvered and hidden behind the curtains of law like in instances where purchasers that were part of the fraud come to courts of law and plead as bona fide purchasers for value without notice. Where court has not been, it now becomes challenging and hard for the judicial officers to judiciously exercise their powers equitably. The study concluded that land transfer is one of the most contested issues in Uganda. In the wake of development strategies in the country, the power to control and to use land in Uganda is seen as an impetus to investors for both agricultural and industrial development. The study recommended that finalization of the land policy, the land policy should be finalized and new legislation based on it should be passed to implement it. As noted above, the government has been developing a new land policy for almost seven years.
