dc.description.abstract | This thesis presents an Examination of the regulatory oversight of the central Bank over commercial banks looking at a comprehensive analysis of banking laws. The Central Bank is mandated under Article 162(1)(c) of the constitution of the Republic of Uganda 1995 as amended, sections 79 and 81 of the Financial Institutions Act, Cap 54 and section 4(2)(1) of the Bank of Uganda Act, to supervise, regulate, and control all financial institutions in Uganda. It is under this mandate that the Central Bank has closed several commercial banks to include Greenland Bank, Global Trust Bank Uganda, Teefee Trust Bank, Crane bank Limited, and National Bank of Commerce. Central Bank is equally endowed with power to manage, receive and liquidate which laces it in a situation of compromise and conflict so as to always liquidate rather than the save the struggling commercial bank. This pauses a question of fairness as the central bank exercises its role. The researcher looks at the legal framework governing the supervision of commercial banks, the different challenges and limitations hindering effective supervision and the consequences and suggestions, recommendations on how the central bank can make the banking system more effective. | |
